Terms of Service
1. Scope and terms
These general terms and conditions regulate the legal relationship between the customer / organizer, hereinafter referred to as the client, and the services of Lemon Event GmbH. Additional provisions and booking conditions may apply to these terms and conditions. In the event of deviations between the order and these terms and conditions, the provisions made in the order confirmation take precedence. The house rules of the individual event locations are an integral part of these general terms and conditions.
2. Performance
Lemon Event GmbH undertakes to provide the scope of services in accordance with the order confirmation made with the client. Lemon Event GmbH reserves the right to change the service in consultation with the client in the event of short-term changes in the market offer (e.g. missing goods, massively increased prices) and undertakes to carry out an order of equal value.
3. Agreement
Based on the information provided by the customer / client, a detailed catering offer is submitted for the event in question. This offer is not binding for the customer / client and Lemon Catering.
The offer is considered binding if it has been accepted by the client. An order with Lemon Event GmbH can be made orally or in writing.
Details of the agreements between the customer and the caterer result from the accepted offer and its attachments (menus, riders, separate purchases for dressing rooms), with the attachments forming an integral part of the agreement between the parties (collectively the "Agreement").
4. Change in the number of people
Deviations in the number of participants of more than 10% must be reported in writing at least 7 days before the start of construction. The definitive number of participants must be communicated no later than 2 working days before the event. This number of people serves as the basis for billing. The full costs will be charged for participants who do not appear.
Changes in the number of people can result in adjustments to the calculated prices.
5. Cancellation of events and reservations
If definitive agreements / bookings are canceled, the confirmed services will be charged as follows:
In case of cancellation of definite agreements/bookings, the confirmed services will be charged as follows:

- Up to 30 days prior to the event: all costs incurred will be charged.
- 14 days to 7 days before the event: 50% of the offered service and 100% of the already incurred costs;
- 7 to 4 working days before the event: 80% of the service offered and 100% of the costs already incurred;
- Three working days before or during the day of the event: 100% of the service offered.
Exception: for international tour catering at home and abroad:
- 50% of the offered service up to 30 days before the first working day and 100% of the incurred costs.
- 100% of the offered service until 14 days before the first working day.

 

6. Infrastructure, cleaning and disposal
Unless otherwise agreed, the customer provides Lemon Event GmbH with the following infrastructure free of charge and undertakes to keep it in a condition suitable for the intended use
to be handed over and received in the same:
- the required spaces
- Heating, water (fresh water and waste water) and electricity
- Free disposal of mixed waste
- Separate staff toilet
- Direct access to the event venue and at least one parking space

7. Liability of the client
The client is liable for any damage (personal injury and / or property damage), even if he is not directly at fault (e.g. theft, accident). This also applies to damage caused by third parties. Lemon Event GmbH is not liable for accidents of event participants, unless they were caused by employees of Lemon Event GmbH. We exclude any liability for services provided by third parties.
8. Prices and terms of payment
The prices offered apply. These are in Swiss Francs, exclusive of statutory VAT. Clients domiciled abroad have to pay 100% of the amount shown in the offer 7 working days before the event. If agreed payments on account are not made on time, Lemon Event GmbH is entitled to withdraw from the contract and to invoice the client for any expenses incurred up to this point in time. If the client is not the organizer at the same time, he and the organizer are jointly and severally liable for the entire invoice amount. Lemon Event GmbH reserves the right to transfer outstanding claims to third parties, whereby processing fees incurred will be offset against the amount owed.
9. Cancellation by Lemon Event GmbH
In the event of force majeure, by order of the authorities or if the contractually agreed advance payment is not met, Lemon Event GmbH is entitled to withdraw from the contract free of charge. If Lemon Event GmbH has justified reason to assume that security is not guaranteed at the event, Lemon Event GmbH can withdraw from the contract. Accrued costs will be invoiced according to the cancellation conditions.
10. Applicable law and place of jurisdiction
These general terms and conditions are subject to Swiss law. The place of jurisdiction is exclusively Zurich.
